Legal information
Legal, Liability, Privacy & Copyright Notice
This page provides general legal terms and risk notices for The Prior website and portal. It is a starter template for Canadian use and should be reviewed by a qualified Canadian lawyer before relying on it for production, customer sales, privacy compliance, or licensing enforcement.
1. No legal, accounting, tax, insurance, or real estate advice
The Prior is a property management workflow and record-keeping tool. Information shown on this website, in the demo, or inside the portal is for general operational and administrative purposes only. It is not legal advice, accounting advice, tax advice, insurance advice, property management advice, real estate brokerage advice, or professional compliance advice. Users are responsible for obtaining appropriate professional advice before making decisions involving leases, notices, evictions, financing, insurance, taxes, repairs, safety, privacy, or regulatory obligations.
2. Canadian landlord and tenant laws vary
Rental property rules differ by province, territory, municipality, property type, lease type, and factual situation. Residential tenancies, commercial leases, notices, rent rules, maintenance obligations, privacy duties, safety requirements, human rights obligations, and dispute procedures may all be different depending on where the property is located. The Prior does not guarantee that any template, reminder, workflow, field, status, document category, or example shown in the portal satisfies the legal requirements that apply to a specific property or landlord.
3. User responsibility for records and decisions
Users are responsible for the accuracy, completeness, lawfulness, and timeliness of all information entered into the portal. Users are also responsible for reviewing reminders, confirming dates, maintaining backup copies, keeping professional records where required, and taking action before deadlines. The Prior may help organize records, but it does not replace the judgment of landlords, owners, property managers, lawyers, accountants, insurers, contractors, or licensed professionals.
4. No guarantee of uninterrupted service or data completeness
The Prior is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we do not guarantee that the website, portal, theme, license system, updates, forms, emails, reminders, two-step authentication, document uploads, or integrations will be uninterrupted, error-free, secure from all threats, or free from data loss. Users should maintain independent backups of important property, tenancy, legal, tax, insurance, and financial records.
5. Limitation of liability
To the fullest extent permitted by applicable law, The Prior, its owners, licensors, developers, contractors, partners, and affiliates are not liable for indirect, incidental, special, consequential, exemplary, punitive, or business-interruption damages, including loss of profits, lost rent, missed notices, failed renewals, disputes, regulatory penalties, data loss, security incidents, or reliance on portal content. Where liability cannot be excluded, liability is limited to the amount paid by the customer for the service during the previous three months, unless a different limit is required by applicable law.
6. Privacy and personal information
Users may enter personal information about tenants, landlords, contractors, agents, and other contacts. Users are responsible for collecting, using, disclosing, retaining, and deleting personal information in accordance with applicable privacy laws and their own privacy obligations. Do not upload sensitive information unless it is necessary, lawful, and properly protected. Contact form and demo form submissions may be stored in WordPress for follow-up, sales, support, and administrative purposes.
7. Security and account access
Users are responsible for using strong passwords, protecting login credentials, enabling and maintaining two-step authentication where available, limiting access to authorized people, reviewing user permissions, and promptly removing accounts that should no longer have access. No website or downloadable WordPress theme can be guaranteed immune from hacking, misuse, server misconfiguration, plugin conflicts, unauthorized modification, or attempts to bypass licensing.
8. License key, updates, and paid access
The Prior theme may require an active license key for private portal features, updates, support, and commercial use. Customers may not remove, disable, reverse engineer, bypass, interfere with, or circumvent license validation, update checks, payment controls, access controls, or other technical protection measures. Expired, unpaid, refunded, disputed, or revoked licenses may lose access to updates, support, premium features, and private portal functionality, subject to the applicable customer agreement.
9. Copyright and intellectual property
Unless otherwise stated, The Prior name, branding, interface design, page layouts, demo content, text, workflows, software code, templates, screenshots, documentation, and related materials are protected by copyright and other intellectual property rights. Customers receive only the license rights expressly granted to them. Copying, redistributing, reselling, sublicensing, white-labeling, publishing, or creating derivative products from The Prior without written permission is prohibited, except where open-source license terms expressly allow it.
10. Third-party services, plugins, and WordPress environment
The Prior may operate alongside WordPress, hosting providers, email services, security plugins, payment processors, authenticator apps, and other third-party tools. We are not responsible for third-party outages, pricing changes, security incidents, plugin conflicts, hosting limitations, or data practices. Users should review the terms and privacy policies of all third-party services used with their installation.
